TERMS OF SALES
The website www.erevanofficiel.com (hereinafter the “Site”) is open to all users of the Internet network.
The Site allows Erevan to offer for sale clothing, perfume, printing or jewelry products (the “Products”) to Internet users browsing the Site (hereinafter the “Customer”).
Erevan reserves the right to adapt or modify these General Terms and Conditions at any time. It is agreed that in the event of modification, the version of the General Terms and Conditions applicable to any Order is the one appearing online on the Site on the day the Order is placed.
These general terms and conditions of sale (hereinafter referred to as "the GTC") apply to any order placed on the website www.erevanofficiel.com (the "site") relating to the purchase of products presented on the site (hereinafter referred to as "the products") by Erevan.
Any order placed for a product appearing in the online store of the site presupposes the prior consultation of these general conditions and their acceptance without reservation and irrevocably. Consequently, the consumer acknowledges being fully informed of the fact that his agreement concerning the content of these general conditions of sale does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented in the site's store. The consumer declares to have the capacity to conclude this contract, that is to say to be of legal age, eighteen (18) years old, and not to be under guardianship.
“Client” Means the contracting party in Yerevan.
“General Conditions of Sale” Means these general conditions of sale and all its annexes
“Order” Purchase order from the Customer for one or more Products and accepted by the Seller in accordance with these General Conditions of Sale
“Day” Means calendar days
“Delivery” Means the provision of the Products to the Customer at the place and on the date agreed upon when placing the Order.
“Products” Means clothing, jewelry, eyewear, printing, laundry detergent, perfumes offered by Yerevan.
“Intellectual Property” Means (a) all kinds of inventions, whether patentable or not, and whether or not they have an identified industrial application, and all improvements relating thereto, as well as all patents, and all other applications, whether initial or divisional, (b) all trademarks and other distinctive signs, whether filed or not, registered or not, and the logos and slogans relating thereto, including company names, (c) all texts and other works or works likely to be protected by copyright, (d) all topographies of semiconductors, (e) all trade secrets, commercial methods, laboratory processes and other know-how of whatever nature or subject matter, (f) all plant variety certificates, (g) all designs and models or other industrial designs, whether filed or not, (h) all rights relating to software, whether registered or not, whether industrial property rights, rights derived from intellectual property rights, or other intellectual property rights, of copyright or ownership of know-how, (i) all rights to databases, (j) all rights to domain names regardless of their suffix, as well as to websites, whether in terms of their structure, appearance or content, (k) more generally all rights to intangible assets likely to correspond to the protection of an idea, and (l) all reproductions, regardless of the form, corporeal or intangible, of the objects of intellectual rights listed above.
The content of the Site is the exclusive property of Erevan and is protected by French and international intellectual property laws. Any total or partial reproduction is strictly prohibited under penalty of prosecution.
The Company is the sole owner of the intellectual property rights to all the Products it offers to its Customers.
In accordance with Article L. 111-1 of the French Consumer Code, Erevan presents the Products for sale and their characteristics on the Site. The Customer has the opportunity to know, before placing a final order, the essential characteristics of the Products he wishes to purchase.
The stock offers presented by the Erevan company are only valid while stocks last.
The photos representing the Products are for informational purposes only. These photos, like the texts illustrating the Products, do not form part of the contractual scope.
The prices appearing on the Site are indicated in euros including VAT and are only valid on the date of validation of the Order by the Customer. Erevan reserves the right to modify them, without notice, at any time, it being understood that the invoicing of the Products will be based on the prices in effect at the time of registration of the Order or Pre-order.
Prices do not include delivery charges, which are charged in addition and indicated before the Order or Pre-order is confirmed. Prices include the VAT applicable on the day of the Order or Pre-order and any change in the applicable VAT rate will be automatically reflected in the price of the Products listed on the Site. Payment of the full price must be made when the Order or Pre-order is placed. At no time may the amounts paid be considered as a deposit or down payment. These prices are guaranteed subject to typographical or printing errors.
The price of Products shipped outside the European Union and French Overseas Territories will be calculated excluding taxes. In this case, the Customer is considered the importer of the products. In the event that customs duties, import taxes or other charges are payable, applicable due to the geographical destination of the products, these costs are the responsibility of the Customer, who is recommended to carry out the necessary checks and procedures prior to confirming their Order.
The Products are payable in euros on the day the Order is actually placed. To pay for their Order, the Customer has only one payment method. The following:
Bank card. For payment by credit card, the Customer provides their bank card number, along with its expiration date, as well as the cryptogram numbers on the back of their bank card. In order to ensure the security of payments made online, the Customer accesses a dedicated space provided by Stripe, which ensures the security and recording of the payment order and the security of the payment itself. In this regard, the Customer expressly acknowledges that providing their bank card number to Yerevan via Stripe constitutes authorization to debit their account for the Products ordered.
Accepted cards are: Visa, Mastercard, American Express, Apple Pay.
Regardless of the payment method used, Yerevan will cover any occasional bank fees incurred by the payment, up to the management fees charged by Stripe or PayPal. All payments are made via Stripe or PayPal. Any other fees, regardless of the reason, will be billed to the Customer.
Erevan reserves the right to suspend or cancel any Order or Pre-order and any delivery in the event of refusal of authorization of payment by credit card from officially accredited organizations or in the event of non-payment. Erevan reserves in particular the right to refuse to make a delivery or to honor an Order or Pre-order from a Customer who has not fully or partially paid for a previous order or with whom a payment dispute is in progress.
The delivered goods remain the property of Erevan until payment is received. The transfer of risks to the Customer takes place upon delivery of the Products.
The computerized records, stored in Erevan's computer systems under reasonable security conditions, will be considered as proof of communications, Orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as evidence.
Any Order will be confirmed when the Customer clicks on the “Place my order” button.
Confirmation of the Order implies acceptance by the Customer of the General Terms and Conditions and the essential characteristics of the Product.
Upon registration of the Order, a confirmation email summarizing the Order (product, price, product availability, quantity, etc.) will be sent to the Customer by Erevan. To this end, the Customer formally accepts the use of email for confirmation by Erevan of the contents of his order. In any case, invoices are given upon delivery.
If the Product is in stock, the Order will be executed no later than 7 days from the day following the day on which the Customer placed his Order. In the event of unavailability of the ordered Product, the Customer will be informed as soon as possible and will have the option to cancel his Order. The Customer will then have the option of being reimbursed.
The refund will be made at the latest within fourteen days following cancellation of the Order.
VIII.I Place of delivery
Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer or any other natural person of their choice, if this is clearly specified when placing the Order. Delivery cannot be made to hotels or PO boxes.
When registering the Customer's personal details, the Customer must ensure the accuracy and completeness of the mandatory data provided. In the event of an error in the recipient's contact details, Erevan shall not be held liable for the inability to deliver the Product.
The Product can also be collected directly from 41 Rue Gambetta in Saint Tropez if the Customer has made this choice at the time of the Order.
VIII.II Delivery times
Delivery times are indicated when the Order is placed. These are indicative times, expressed in working days and corresponding to the average processing and delivery times.
Yerevan cannot be held responsible for the consequences of a delay in delivery which is not its fault or which is due to an act of force majeure.
VIII.III Receipt of the product
Delivery is deemed to have been made upon delivery of the Product to the Customer by the carrier, as evidenced by the control system used by the latter.
Upon receipt of the Product, the Customer is required to check the condition of the packaging of the goods and to report any damage due to the carrier on the delivery slip, as well as to Erevan, within three (3) days by sending an email using the contact form on our website.
The Customer may, at his request, have an invoice sent to the billing address and not to the delivery address.
Shipping costs are payable by the customer in France and worldwide. Return costs will be covered by Erevan in the event of withdrawal or return due to non-compliance, except when the delivery address is not located in France. We will cover return costs if necessary in France, but these costs are the responsibility of our international customers, except in the case of non-compliance of a product, in which case we will cover the return shipping costs.
Erevan is liable for any lack of conformity existing upon delivery of the Product under the conditions of Articles L. 217-4 et seq. of the Consumer Code.
When acting under the legal guarantee of conformity, the Client:
- Benefit from a period of two years from delivery of the Product to act.
- May choose between repair or replacement of the goods; in accordance with Article L. 211-19 of the Consumer Code, Erevan may not, however, proceed according to the Customer's choice if this choice entails a cost that is manifestly disproportionate to the other method, taking into account the value of the goods or the extent of the defect. It is then required to proceed, unless impossible, according to the method not chosen by the Customer.
- Is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.
This legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
The Customer may decide to implement the guarantee against hidden defects in the item sold within the meaning of Article 1641 of the Civil Code, which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if they had known about them. In this case, he may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
The action resulting from latent defects must be brought by the Customer within two years of the discovery of the defect.
In accordance with Articles L 221-18 et seq. of the Consumer Code, the Customer has a period of fourteen clear days from the date of delivery of the Order to exercise their right of withdrawal from their order.
This period starts from the receipt of the product by the Customer.
The Customer must attach to his request for withdrawal a copy of the invoice or any other element allowing identification of the Order in question and its holder.
Only the Customer identified as such to Erevan can exercise this right, to the exclusion of any other person, and in particular the person receiving the delivery (for example in the case of a gift).
This clause does not apply to sales made "Made to Measure" or "Made to Order" in erEvan physical stores.
Any exchange or return must be declared by the Customer to Erevan via the Site's contact form, within fourteen (14) days of delivery. Printed withdrawal forms are delivered in each package delivered to the Customer.
The Product must be returned by the Customer no later than fourteen (14) days following communication of his decision to withdraw.
The Product must be returned by the Customer in its original packaging or any equivalent packaging and in perfect condition, to request an exchange, refund or credit note without penalty.
If the package is lost or damaged during the return of the product, the cost of the damage is the responsibility of the Customer.
Any Product that is not returned within the time limits and conditions referred to above will not be refunded or exchanged by Erevan.

In accordance with Article L. 221-24 of the French Commercial Code, Erevan undertakes to reimburse the sums collected under the Order within fourteen (14) days. This period runs from the first of the following two dates: (i) receipt by Erevan of the returned Product or (ii) receipt by Erevan of proof of shipment of the Product by the Customer.
The refund will be made by crediting the Customer's bank account corresponding to the bank card used to pay for the Order. If you have changed bank accounts, remember to provide your new bank details to your old bank.
These general terms and conditions are subject to French law. In the event of a dispute or complaint, the Client shall first contact Erevan to seek an amicable solution.
The Customer is informed that any consumer may use a consumer mediator free of charge to resolve a dispute with a professional amicably. Consumer mediation applies to any national or cross-border dispute between a consumer and a professional in the context of the execution of a sales or service contract.

The request cannot be accepted by the consumer mediator if:
1° The Client does not prove that he has previously attempted to resolve his dispute directly with the company Erevan by means of a written complaint in accordance with the terms provided;
2° The request is manifestly unfounded or abusive;
3° The dispute has previously been examined or is being examined by another mediator or by a court;
4° The consumer submitted his request to the mediator within a period exceeding one year from his written complaint to the company Erevan;
5° The dispute does not fall within its scope of jurisdiction.
The consumer is informed by the mediator, within three weeks of receipt of his file, of the rejection of his request for mediation.
In the absence of recourse to mediation, the courts of the jurisdiction of the company's registered office will have jurisdiction.
In order to provide the services offered on the Site, Erevan may be required to process personal data concerning you, in particular those collected when you registered on the site, or when you placed your order.
The information and data concerning the Customer are strictly necessary for the management of orders, the execution and monitoring of commercial relations, as well as for internal statistical purposes. This data may be transmitted to the companies involved in these relations (such as those responsible for the execution of services and orders) for their management, execution, processing and payment. This data is also retained in order to pursue objectives of security, identification, improvement and personalization of services.
The Client has the right to access, rectify and oppose personal data concerning him/her at any time, under the conditions provided for by the law of

On the Site offered by Erevan, the Customer may have access to hyperlinks to other sites. These hyperlinks established towards other sites from the site erevanofficiel.com cannot, under any circumstances, engage the responsibility of Erevan.
